Terms of Service

Effective date: June 7, 2026

These Terms of Service (the “Terms”) govern your access to and use of the FiveStarKit platform, websites, and related services (the “Service”) operated by FiveStarKit, LLC (“FiveStarKit,” “we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and able to form a binding contract. If you sign up on behalf of a business, you represent that you are authorized to bind that business to these Terms, and “you” refers to both you and that business. The Service is offered to service-business operators (such as plumbers, electricians, HVAC technicians, and handymen) located in the United States.

2. Your account

You are responsible for keeping your account credentials secure, for all activity that occurs under your account, and for ensuring that your business name, trade, phone number, email address, and any other account information you provide is accurate and current. Notify us at support@fivestarkit.app if you believe your account has been compromised.

3. The Service

FiveStarKit helps you:

  • Send one-tap SMS review requests to your customers and track delivery, clicks, and opt-outs.
  • Monitor new Google reviews of your business and receive alerts.
  • Generate AI-drafted response suggestions you can edit and post to Google.
  • Collect private feedback from customers who indicate a low-star experience before they post publicly.

Specific features may change over time. We may add, modify, or remove features at our discretion.

4. Subscription, billing, and free trial

Paid plans are billed through our payment processor, Polar. The Starter plan is $49 per month and includes a 14-day free trial. After the trial, your subscription renews automatically each billing period until you cancel. You can cancel at any time through the customer portal; cancellation takes effect at the end of your current billing period.

Prices and plan inclusions may change with at least 30 days’ notice for existing subscribers. You are responsible for all applicable taxes.

5. Refunds

If you are not satisfied within the first 30 days after your first paid charge, contact support@fivestarkit.app and we will issue a refund for that charge. Refund requests after 30 days are evaluated case-by-case and not guaranteed.

6. SMS compliance and your responsibility as the sender

FiveStarKit sends SMS messages on your behalf to phone numbers you provide. You represent and warrant that, for every phone number you upload, type in, or otherwise submit to the Service:

  • You have obtained the recipient’s prior express consent to receive SMS messages from your business, including review-request messages.
  • You will honor opt-out requests immediately and will not attempt to re-message anyone who has opted out (including through means outside FiveStarKit).
  • You comply with the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, CTIA messaging guidelines, A2P 10DLC requirements, and all other applicable laws and carrier rules.

We honor “STOP,” “UNSUBSCRIBE,” and similar replies platform-wide and will not send further messages to any opted-out number from any account. You are the “sender” of every message for legal purposes and are solely responsible for the lawfulness of your messaging program. You will indemnify FiveStarKit for any claims, fines, or damages arising from messages sent to numbers that did not give the required consent or from your other violations of messaging law.

7. Google account and data

To use the review-monitoring and response features, you authorize FiveStarKit to access your Google Business Profile through the Google Business Profile API using the business.manage scope. We use this access only to fetch reviews and post responses you approve. OAuth tokens are encrypted at rest. You can revoke our access at any time at myaccount.google.com/permissions; revoking access will disable Google-dependent features of the Service.

8. AI-generated drafts

FiveStarKit uses third-party large language models (currently Anthropic Claude) to generate suggested response drafts. Drafts are suggestions only. You are responsible for reviewing every draft before posting and for the content of any response you choose to publish. FiveStarKit makes no warranty that drafts are accurate, appropriate, or compliant with Google policies, and is not liable for the consequences of any response you post.

9. Acceptable use

You agree not to:

  • Use the Service to send any SMS unrelated to soliciting genuine reviews from real customers of your business.
  • Solicit, post, or pay for fake, incentivized, or otherwise inauthentic reviews, or take any action that violates Google’s review policies.
  • Misuse Google OAuth access (for example, by attempting to read data outside the granted scope).
  • Scrape, reverse-engineer, or attempt to derive the source code of the Service.
  • Impersonate any person, business, or entity, or upload data you do not have the right to use.
  • Interfere with, overload, or disrupt the Service or attempt to bypass rate limits or other technical protections.

10. Intellectual property

We own the Service, including the software, design, and all FiveStarKit trademarks. You own your account data and the content you submit. You grant us a worldwide, non-exclusive, royalty-free license to host, store, transmit, display, and process your content solely to operate, secure, support, and improve the Service. We may use aggregated and de-identified data derived from the Service for analytics, benchmarking, and product improvement.

11. Termination

You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your access if you breach these Terms (including the SMS compliance and acceptable-use sections), if your account becomes delinquent, or if your continued use creates legal or operational risk for FiveStarKit, our processors, or our carriers. We will give you a reasonable opportunity to export your data after termination, except where prohibited by law or where the breach makes that impractical.

12. Disclaimers

The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty arising out of course of dealing or usage of trade. We do not warrant that the Service will be uninterrupted, error-free, or secure, nor do we guarantee that using the Service will increase your review count, star rating, search ranking, or revenue.

13. Limitation of liability

To the maximum extent permitted by law, FiveStarKit and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost data, or business interruption, even if advised of the possibility. Our total aggregate liability for any claim arising out of or relating to these Terms or the Service will not exceed the greater of (a) the amount you paid us for the Service in the 12 months immediately before the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).

14. Indemnification

You will defend, indemnify, and hold harmless FiveStarKit and its officers, employees, and agents from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Service in violation of these Terms or law, including any TCPA or other messaging-law violation; (b) any content you submit or post through the Service; (c) any review or response published from your account; and (d) your infringement of any third-party rights.

15. Governing law and venue

These Terms are governed by the laws of [Jurisdiction], without regard to its conflict of laws principles. The state and federal courts located in [Jurisdiction] will have exclusive jurisdiction over any dispute that is not subject to binding arbitration, and you consent to personal jurisdiction in those courts.

16. Changes to these Terms

We may update these Terms from time to time. For material changes, we will notify you by email or in-app notice at least 30 days before the change takes effect. Your continued use of the Service after a change becomes effective constitutes acceptance of the updated Terms. If you do not agree, you must stop using the Service before the effective date.

17. Miscellaneous

These Terms, together with our Privacy Policy, are the entire agreement between you and FiveStarKit and supersede any prior agreements on the subject. If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce a right is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
